Terms of Service
These Terms of Service ("Terms") govern your use of the websites and messaging programs operated by Gothic Walks LLC, dba Like Old Friends ("LOF," "The LOF Club," "we," "us"), based in Savannah, Georgia. By signing up for a Venue's messaging program or using our sites, you agree to these Terms and to our Privacy Policy.
1. What the service is
The LOF Club is a guest capture and return-visit messaging service that we operate on behalf of participating local venues ("Venues"). When you opt in at a Venue, we send text messages (and emails, if you provided an email address) on that Venue's behalf — welcome notes, visit invitations, event announcements, review requests, prize drawing notifications, and occasional recommendations from local businesses the Venue loves.
2. Text messaging program terms
- Program name: The LOF Club.
- Opt-in: You will only receive messages if you provide your phone number and agree to the consent language presented at sign-up. Consent is not a condition of any purchase.
- Message frequency: Varies by Venue and season; typically a few messages per month per Venue program.
- Costs: Message and data rates may apply according to your mobile plan. We do not charge you for the program.
- Opt-out: Reply STOP to any message to cancel. You will receive one confirmation message, after which no further messages will be sent for that Venue's program.
- Help: Reply HELP to any message, or email hello@likeoldfriends.com.
- Carriers: Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator.
3. Eligibility
The messaging program is intended for adults. By opting in, you represent that you are at least 18 years old and are the current subscriber or customary user of the phone number you provided, and that you will notify us if you release that number.
4. Prize drawings
From time to time we administer prize drawings on behalf of Venues. No purchase is necessary to enter or win unless otherwise stated in the drawing's posted rules. Specific eligibility, entry, and selection terms will be provided with each drawing. Void where prohibited.
5. Acceptable use
You agree not to misuse the service — including submitting phone numbers that are not yours, attempting to interfere with the operation of the service, or using it for any unlawful purpose.
6. Intellectual property
The LOF Club name, site content, and materials are owned by Gothic Walks LLC or its licensors. Venue names and marks belong to the respective Venues. You may not use them without permission.
7. Disclaimers
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that messages will be delivered, timely, or error-free. Offers communicated through the program are made by the Venues and are subject to the Venues' own terms and availability.
8. Limitation of liability
To the maximum extent permitted by law, Gothic Walks LLC and its members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to the service. Our total liability for any claim relating to the service will not exceed one hundred dollars ($100).
9. Indemnity
You agree to indemnify and hold harmless Gothic Walks LLC from claims arising out of your misuse of the service or violation of these Terms.
10. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Chatham County, Georgia, and you consent to their jurisdiction.
11. Changes
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Continued participation after changes take effect constitutes acceptance.
